- El ecutivo no ha respetado el protocolo jurídico para extinguir formalmente al organismo descentralizado; la relación laboral sigue vigente, subraya la diputada.
Morelia, Michoacán, 25 de enero del 2019.- La Comisión de Desarrollo Urbano, Obra Pública y Vivienda del Congreso del Estado convoca al Gobierno de Michoacán a dar certeza a los trabajadores de la Junta de Caminos, ya que, no obstante que el Ejecutivo no destinó partida presupuestal para su operación este año, jurídicamente tampoco se ha concretado la extinción de este organismo público descentralizado.
Trabajadores de la Junta de Caminos expusieron a Sandra Luz Valencia (Morena), Teresa López Hernández (Morena) y Humberto González Villagómez (PRD) -integrantes de la referida Comisión-, su preocupación porque en el Decreto que contiene el Presupuesto de Egresos para el ejercicio fiscal 2019 (publicado en el Periódico Oficial el 31 de diciembre del 2018) no se asigna ninguna partida presupuestal para la operación del organismo, pero sí se específica el monto que se destinaría para la liquidación de los trabajadores ante la extinción del mismo.
La presidenta de la Comisión, Sandra Luz Valencia, puntualizó que el Gobernador no ha seguido el protocolo legal para extinguir formalmente a la Junta de Caminos, ya que al ser creado este organismo público descentralizado por decreto legislativo publicado el 16 de marzo de 1989, el Ejecutivo no puede declarar su extinción de manera unilateral.
En tanto el Gobierno de Michoacán no concrete la extinción de la Junta de Caminos conforme lo estipula la Ley de Entidades Paraestatales -mediante ley o decreto-, el Ejecutivo estará violentando sus derechos laborales puesto que permanece vigente la relación obrero-patronal, dijo a los trabajadores la diputada de Morena.
Sandra Luz Valencia subrayó que el Gobierno del Estado debe evitar la opacidad en la extinción de la Junta de Caminos, ya que los michoacanos deben saber con claridad el destino que se le dará a la maquinaria, inmuebles, predios y otros bienes materiales que pertenecen a este organismo que fue creado con personalidad jurídica y patrimonio propios.
La diputada por el distrito de Apatzingán explicó que el Ejecutivo de Michoacán informó al Congreso su intención de gastar $64,555,242.00 en la liquidación del personal adscrito a la Junta de Caminos; cantidad reservada en la UPP “Erogaciones Adicionales y Provisiones”.
La Comisión de Desarrollo Urbano, Obra Pública y Vivienda acordó solicitar al Gobierno del Estado una reunión para que sea aclarado el destino de la Junta de Caminos, y se garantice el estricto apego a los protocolos legales; “Los integrantes de la Comisión vamos a velar por los derechos de los trabajadores tanto de base, como los de contrato y de confianza y exigiremos que se les respeten todas las garantías que les confiere la ley”.
